What is this 19th Amendment ?

Introduction

When considered the constitutional history of Sri Lanka, the 19th amendment to the constitution is one of the progressive amendments. After the repeal of the 17th amendment and the introduction of the 18th amendment there have been discussions about bringing back the concept of Rule of Law, Separation of powers, transparency and accountability seen in the 17th A. Thus it had been the key concern of the drafters to bring forth an amendment which protects the sovereignty of the electorate.

Therefore this will analyze the extent to which the 19A was successful by analyzing its provisions alongside the principles and themes of good governance.

The 19A re-introduces a few concepts which were mentioned in the 17A such as the “Constitutional council” and introduces new provisions alongside it. This essay will analyze only a selected number of provisions seen in the 19A .

The Constitutional Council

The main reason behind the introduction of the CC is to “de-politicize the process of making appointments” to the independent commissions which were heavily influenced by politicians and were manipulated according to their will since 1972.

The CC improves the integrity and impartiality in making appointments to the high offices while preserving the rule of law and acting as a check against arbitrary use of presidential power where the de-politicization allows them to carry on with their tasks independently. It acts as an agent against nepotism, patronage politics and corruption. But whether the existence of the CC effectively preserve the independence in practice is a question as the CC itself is appointed by the president where majority of its members are from the parliament who even get to approve the nominations of the non-MPs. The supremacy of the parliament is upheld using this clause and the unnecessary immunity vested impair the true objective of having a CC. Furthermore the president still possesses the final authority in making any decision though the automatic approval system is introduced to terminate that practice. Therefore the principle of constitutional democracy can be ignored in the process.

But accountability in exercise of powers of the president and the member of the CC is maintained to a certain extent than in the previous 18A. Those values are retained through the transparent process used in relation to the duties of the CC.

The utilization of the concept of technocracy in appointments helps to bring out both the legislature’s view and an academic view on matters which ultimately acts as a check on appointing incompetent individuals to office.

The clauses on the CC imply the idea of rejecting ethno-nationalism and reviving consociationalism in the country as they encourage minority representation which is probably a step in national reconciliation in transitional justice mechanisms. Furthermore the 19A is a step ahead of 18A as it represents the minority ethnic groups and encourages representation of women.

Executive Presidential Powers

Sri Lanka adapted the Gaullist practice of executive presidentialism where the president has both extensive powers and immunities which is very unfavourable as it weakens the rule of law and promotes arbitrary executive of power by weakening the independence of the judiciary and undermining the sovereignty of the parliament.

Under these circumstances, the insertion of a clause on reduction of presidential immunity gave the Sri Lankan promising start towards the abolition of the executive presidency. Fundamental rights petition could be filed against the “Attorney General in respect of anything done or omitted to be done by the president.” The provision also states that it must be done in the president’s “official Capacity” which limits the scope of the application of the provision. Nevertheless it is not practical to summon a president to court for every single decision taken by him and therefore article 35 can be regarded as a progressive clause.

Reducing the presidential term of office and the 2 term limit are among other changes made to the presidential powers as the “constitution did not intend the president to function as an unfettered repository of executive power unconstrained by the other organs of governance”. The restrictions were repealed in the 18A which allowed arbitrary exercise of presidential power, authoritarianism and totalitarianism under an “extremely powerful executive president”. Therefore imposing those limits to the presidential power in the 19A is a development.

Moreover, the 19A has imposed many limitations to the exercise of power by the president which is evidently done to minimize the arbitrary exercise of the power by the executive. First, the power of the president was limited to the appointments to the independent commissions where he had to accept the recommendations of the CC, and it is further reduced as even-though the president rejects to appoint the recommendations, they will be automatically accepted. But the presidential powers related to the appointment of the “Heads of the Army, the Navy, and Air Force subject to the approval of the CC”….. and his power to recommend names for the posts of the judges in the “supreme court, Court of appeal” to the CC to approve are still intact as the supreme court determination states that if presidential powers are dissolved even more that would be unconstitutional according to article (3) read with article 4(b) of the constitution. Thereby concluding that only a new constitution can effectively limit or liquidate the executive powers.

The tightened grip, the president had over the matters of the parliament has also been loosened where he is responsible to the parliament and he cannot remove the Prime Minister from his office “at his discretion” further highlighting the importance of the role of a prime minister which was neglected by many of the earlier executive presidents.

The advice clause which was also a new addition to the constitution proves that the Prime minister is not merely a figure head and that the president should cooperate with him in decision making. The prime minister may advice or consult the president “when appointing or removing from office any cabinet minister, non-cabinet minister or deputy minister”. The new provision strengthens the principle of constitutional democracy and improves effective separation of powers. But as mentioned earlier the president has the final authority to make decisions even after obtaining advice from the Prime minister and the “president may at any time change the assignment of subjects and functions of both cabinet and non-cabinet minister” which may again lead to the arbitrary exercise of presidential power.

The executive President is also denied of the privilege of submitting “to the people by referendum any Bill which has been rejected by the parliament”.26 This provision further strengthens the sovereignty and the supremacy of the parliament and ratifies the concept of separation of powers where the President doesn’t get to encroach on a decision made by the parliament.

The President has also been deprived of the power to “assign himself any subject or function” by the repeal of that provision, but special provisions have been made for the person holding office as President on the date of commencement of the 19A.27 This can be taken as a violation of equality and an interference to the rule of law where one President gets to bend the law according to his wishes.

Changes made to other provisions

Right to information clause

The inclusion of a new provision for the right to information where “every citizen shall have the right to access to any information… required for the exercise or protection of a citizen’s right” protects the sovereignty of the people. It implies of the government’s responsibility for maintaining transparency where they will have to refrain from the arbitrary exercise of power, misappropriation of public funds, nepotism and corruption which many past governments have been alleged of. But an issue was raised with regard to Article 14A(2) where it was mentioned that even a “foreigner with the help of four other citizens of Sri Lanka” will have access to information “via setting up a hoaxed unincorporated body” but that provision was not repealed and was later adapted in to the amendment.

Urgent Bills and Pre-enactment review

The Article on passing urgent Bills was repealed by the 19A which has been abused when passing both the 17A and the 18A even-though there was no necessity to pass a constitutional amendment which is not something related to national security or terrorism. It also increased from 7 to 14 days, the period of time a Bill is to be published in the gazette, “before it can be placed on the order paper of the parliament”. Though it’s a minor improvement, this grants more time to the general public to propose and submit their petitions. It has been acknowledged by many, that Sri Lanka needs post enactment review as it is used in the United States of America, but the counter-argument states that then the judiciary will act as another legislature encroaching on the powers of the parliament while undermining its supremacy.

Conclusion

The 19th Amendment is recognized as one of the most progressive constitutional reforms to the 1978 republic Constitution, it has been praised for the re-introduction of the constitutional council and the restriction of Presidential term of office which was arbitrarily repealed through the 18th Amendment. It has introduced a new provision on the Right to Information and reduced many powers that could be arbitrarily exercised by the President.

But the new government was brought in to power with the hope that it will uphold the rule of law while being a transparent, accountable, impartial body which will preserve constitutional democracy. They were also expected to abolish the Executive Presidency which was reduced to minor transfers of power to the Prime Minister with regard to the appointment of the Cabinet ministers and other ministers. Even the process in which the amendment was brought in was condemned as it was a much diluted version from the proposed Bill where the public expectations were not met through the 19th Amendment. It can be stated that the 19th Amendment is merely whitewashing the deep rooted constitutional problems which have been expanded in to ethnic, economic and social crisis. The introduced provisions, though they seems to be working under the coalition of the incumbent President and the Prime Minister is prone to abuse under an authoritarian ruler. Therefore it can be concluded that although when compared with the other amendments, the 19th Amendment can be recognized as an effective introduction but as a country with more deep-rooted problems, we cannot be satisfied with a seemingly enough solution. It is frustrating to know that even the nineteenth amendment to the constitution was incapable or bringing substantial change towards the development of the society and therefore it has failed to bring about the change of good governance the nation desired.
